These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User” or “you”) and Zelonai (“Company,” “we,” “us,” or “our”) governing your access to and use of the ImageTinify mobile application (the “App” or “Service”).
Please read these Terms carefully before using the App. By downloading, installing, accessing, or using ImageTinify, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. The Service (Local Processing Focus)
ImageTinify is a utility application designed to compress image files directly on your iOS device.
We place a high priority on your privacy. Crucially, ImageTinify operates entirely locally on your device. We do not require user accounts. The images you select for compression, along with any processing history or statistics, remain solely on your device and are never transmitted to our servers or third parties for processing or storage.
2. Intellectual Property Rights
Your Content: You retain all ownership rights to the photos and images you process using the App. We claim no ownership over your content. By using the App, you confirm that you have the necessary rights and permissions to use and compress the images you select.
Our App: The App itself, including its code, design, visual interfaces, graphics, branding, and all related intellectual property rights, are the exclusive property of Zelonai or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App on your iOS device for personal, non-commercial use, subject to these Terms. You agree not to reverse engineer, decompile, or attempt to extract the source code of the App.
3. Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You are solely responsible for your conduct while using the App. You agree not to use ImageTinify:
- In any way that violates any applicable local, national, or international law or regulation.
- To compress or process content that is illegal, infringing, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- To infringe upon the intellectual property rights (including copyright, trademark, or privacy rights) of others.
- To attempt to interfere with or compromise the system integrity or security of the App or the device environment.
4. Fees and Subscriptions
The current version of ImageTinify provides core features free of charge.
We reserve the right to introduce premium features or subscription plans in the future. If we do, pricing, features, and renewal terms will be clearly disclosed within the App prior to purchase. Any such transactions will be processed through Apple’s In-App Purchase system and will be subject to Apple’s Media Services Terms and Conditions.
5. Disclaimer of Warranties (“As Is” Clause)
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.
WE DO NOT WARRANT THAT THE IMAGE COMPRESSION RESULTS WILL MEET YOUR EXPECTATIONS OR THAT THE APP WILL BE COMPATIBLE WITH ALL DEVICE CONFIGURATIONS. YOU BEAR THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE APP ON YOUR DEVICE.
6. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ZELONAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
SPECIFICALLY, AS PROCESSING OCCURS LOCALLY ON YOUR DEVICE, WE ARE NOT LIABLE FOR ANY DATA LOSS, FILE CORRUPTION, OR DEVICE ISSUES ARISING FROM FAILED COMPRESSION OPERATIONS, DEVICE LIMITATIONS, OR USER ERROR.
IN NO EVENT SHALL ZELONAI’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP EXCEED THE AMOUNT YOU PAID US, IF ANY, FOR ACCESSING THE APP DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.
7. Termination
We reserve the right to terminate or suspend your license to use the App at our sole discretion, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, you must cease all use of the App and uninstall it from your device.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of [Insert Your Country/Jurisdiction Here, e.g., Singapore / State of California, USA / China], without regard to its conflict of law principles.
